invers-color'  itemprop=\"text\" ><h3>Trade in Austria<\/h3>\n<p>Self-employed professional services in Austria regulated by a manyfold legal restrictions. Traditional trade (e.g. construction, installation works) subject to the Austrian (public) Trade Act. A company may offer these services in Austria only after registration of its activities with the great authority.<\/p>\n<p>Depending on trade, the company has to prove its professional qualifications or appoint a manager (\u201etrade manager\u201c) who fulfills the relevant criteria and qualifications for the requisite trade. For especially responsible activities, e.g. construction activities, the manager needs to prove his specific reliability in this trade.<\/p>\n<p>Individuals may exert self-employed activities only with an adequate <a href=\"https:\/\/www.rihs.law\/en\/services\/private\/residence-settlement-citizenship\/\">residence permit<\/a>, e.g. a red-white-red card for self-employed persons.<\/p>\n<\/div><\/div><\/section>\n<section class='av_tab_section av_tab_section av-av_tab-1aa7d21037070ad74134851db1e5d7a0'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='tab' role='tab' tabindex='0' data-fake-id='#tab-id-2' aria-controls='tab-id-2-content'  itemprop=\"headline\" >Cross-border services by foreign companies in Austria<\/div><div id='tab-id-2-content' class='tab_content' aria-hidden=\"true\"><div class='tab_inner_content invers-color'  itemprop=\"text\" ><h3>Cross-border services by foreign companies in Austria<\/h3>\n<p>Companies from other member states of the European Union or the European Economic Area may rely on the freedom of services. In principle, companies from member states who have registered a trade (profession) in another member state may offer their professional services in Austria. However, special rules of the Austrian (public) Trade Act apply. These rules were (arguably) implemented to facilitate access of companies from other member states in Austria in relation to companies from so-called third countries, i.e. countries outside the European Union or the European Economic Area.<\/p>\n<p>The so-called <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/HTML\/?uri=CELEX:32006L0123&amp;from=DE\">Services Directive 2006\/123\/EC<\/a>\u00a0provides for additional facilitations, especially concerning the acceptance of trade registrations and professional qualifications acquired in other member states of the European Union.<\/p>\n<p>The Austrian (public) Trade Act still contains restrictions of the freedom of services. E.g. a German construction company may temporarily perform its trade in Austria, for example on a construction site, only after prior notification of its services to the Austrian authorities.<\/p>\n<p>For the participation in tenders of Austrian public contractors, compliance with the Austrian (public) Trade Act is quintessential. A company does not have to start ist operations in Austria in ordert to \u201eperform services\u201c in the sense of the Trade Act. In one instance, the Austrian Supreme Administrative Court has qualified the registration of a company in the public register of companies as commercial activity, concluding that the company is required to fulfill all administrative requirements for trade and professional activities upon entry into the public register of companies (Supreme Administrative Court, 23.11.2016, <a href=\"https:\/\/www.ris.bka.gv.at\/Dokument.wxe?Abfrage=Vwgh&amp;Dokumentnummer=JWT_2016040098_20161123L00\">Ra 2016\/04\/0098<\/a>).<\/p>\n<p>Offenses against the Austrian trade regulations, it just the Austrian trade act and ancillary legislation for specific trades, may result in severe (administrative) fines.
