{"id":4348,"date":"2019-11-19T13:13:56","date_gmt":"2019-11-19T12:13:56","guid":{"rendered":"https:\/\/www.rihs.law\/?p=4348"},"modified":"2021-11-26T17:00:22","modified_gmt":"2021-11-26T16:00:22","slug":"documentation-requirements-according-to-lsd-bg","status":"publish","type":"post","link":"https:\/\/rihs-old.mycodingbase.at\/en\/news\/documentation-requirements-according-to-lsd-bg\/","title":{"rendered":"Documentation requirements according to LSD-BG: EuGH Maksimovic and &#8220;Implementation&#8221; in Austria"},"content":{"rendered":"<p><strong>Posting of workers, notificaiton and procurement of documentation for posted workers: European Court of Justice\u2019s judgement 12 September 2019 with severe consequences for companies and their managers -Documentation requirements according to LSD-BG<br \/>\n<\/strong><\/p>\n<p>On occasion of a spectacular case in which managers of a renowned Styrian company were fined millions of Euros for infringements of a sub-contractor against documentary obligations, the European Court of Justice decided on the adequacy of the Austrian obligations to provide documentation in the context of posting of workers <a href=\"https:\/\/curia.europa.eu\/juris\/document\/document.jsf;jsessionid=F6D22787FFAEF6520C573B315E44EDAE?text=&amp;docid=217671&amp;pageIndex=0&amp;doclang=de&amp;mode=lst&amp;dir=&amp;occ=first&amp;part=1&amp;cid=2446039\">(ECJ 12.9.2019, C-64\/18, Maksimovic and others)<\/a>.<\/p>\n<p>The ECJ ruled that the applicable provisions were inadequately severe in so far as<\/p>\n<ul>\n<li>the Anti-Wages and Social Dumping Act (LSD-BG) provides for minimum fines which may not be reduced,<\/li>\n<li>the fine increases per every single worker concerned by the infringement to provide documentation on the salary and relevant facts, without any cap,<\/li>\n<li>in case of uncollectibility, the fine is automatically converted into imprisonment, and<\/li>\n<li>on appeal, an additional 20 % will be added to the imposed fines.<\/li>\n<\/ul>\n<p>The Austrian Supreme Administrative Court has ruled on the legal consequences of the ECJ-judgement on the applicability of the penal provisions of the Austrian Act for the Prevention of Social and Wages Dumping (short: \u201eLSD-BG\u201c).
